Vorausschauende Planung von Infrastruktur

Deutsch. Der Infrastrukturausbau beeinträchtigt vielfach Umweltbestandteile, ist kostenintensiv und greift in Grundrechte der Betroffenen ein. Das betrifft insbesondere den Ausbau großflächiger Netze, etwa der Strom- und Telekommunikationsinfrastruktur. Der Planungsmodus der vorausschauenden Planung soll den Infrastrukturausbau erleichtern, indem er die Bündelung von Vorhaben ermöglicht, die im selben Raum, aber nicht zeitgleich realisiert werden. Hierbei sollen sogenannte Vorhaltemaßnahmen die schonende spätere Realisierung des zeitlich nachfolgenden Vorhabens ermöglichen. Die vorliegende Untersuchung erarbeitet Grundlagen und verfassungsrechtliche Grenzen vorausschauender Planung. Es wird aufgezeigt und analysiert, wie die §§ 43 Abs. 2 S. 1 Nr. 6, 43j EnWG, 18 Abs. 3 NABEG und die §§ 125 ff. TKG vorausschauende Planung im Stromleitungs- bzw. Telekommunikationsnetzausbau ermöglichen. Es wird überprüft, ob vorausschauende Planung ein verallgemeinerungsfähiger Planungsmodus ist. Englisch. »Anticipatory Planning of Infrastructure. This thesis examines this approach by outlining the foundations and constitutional limits of anticipatory planning and by analysing the existing legal provisions governing it. It further assesses whether anticipatory planning constitutes a planning mode capable of generalisation.
